Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and JCM Studios, developed by João de Carvalho Milone and published by CrossBlack Studios ("we", "us", or "our"), regarding your use of the mobile game application Tornado.io 3 - Battle Arena (the "Game").

By accessing or using the Game, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not download, install, or use the Game.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game on your personal mobile device solely for your personal, non-commercial entertainment purposes.

2.1 License Restrictions

You agree not to:

• Copy, modify, or create derivative works of the Game
• Reverse engineer, decompile, or disassemble the Game
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
• Use the Game for any commercial purpose or for the benefit of any third party
• Transfer, rent, lease, lend, sell, or sublicense the Game
• Use any cheats, exploits, automation software, bots, hacks, or unauthorized third-party software
• Attempt to gain unauthorized access to any portion of the Game or related systems

3. User Accounts and Data

The Game may allow you to create an account or save game progress through Firebase and platform-specific services (Google Play Games, Apple Game Center).

You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Ensuring your account information is accurate and up-to-date
• Notifying us immediately of any unauthorized use of your account

4. User Conduct

While using the Game, you agree to:

• Comply with all applicable laws and regulations
• Respect other players and use appropriate conduct
• Not engage in any abusive, harassing, or offensive behavior
• Not attempt to interfere with or disrupt the Game or servers
• Not use the Game to transmit any malicious code or software
• Not impersonate any person or entity
• Not collect or harvest any information about other users

We reserve the right to suspend or terminate your access to the Game if you violate these conduct rules or any other provision of these Terms.

5. In-App Purchases

The Game may offer in-app purchases for virtual items, currency, or other digital content ("Virtual Items"). All purchases are final and non-refundable, except as required by applicable law or as expressly stated in these Terms.

Important notes about Virtual Items:

• Virtual Items have no monetary value and cannot be exchanged for real money
• Virtual Items are licensed, not sold, and remain our property at all times
• We may modify, manage, control, or eliminate Virtual Items at any time
• Virtual Items may expire and are forfeited if your account is terminated
• Purchases are processed through the Apple App Store or Google Play Store, subject to their terms

6. Advertising

The Game displays third-party advertisements through Google AdMob. By using the Game, you acknowledge and agree that:

• Advertisements are an integral part of the Game
• We may display various types of advertisements during gameplay
• Third-party advertisers may collect data as described in our Privacy Policy
• We are not responsible for the content of third-party advertisements
• Your interaction with advertisements is governed by the advertiser's terms and policies

7. Intellectual Property Rights

The Game and all its content, features, and functionality (including but not limited to all information, software, code, text, graphics, logos, images, audio, and design) are owned by JCM Studios and published by CrossBlack Studios. All content is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

All trademarks, service marks, and trade names are proprietary to us or our licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or other brand features without our prior written permission.

8. Privacy and Data Collection

Your privacy is important to us. Our collection and use of personal information in connection with the Game is described in our Privacy Policy, which is incorporated into these Terms by reference.

By using the Game, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.

9. Updates and Modifications

We reserve the right to modify, update, or discontinue the Game (or any part thereof) at any time with or without notice. We may release updates, patches, or new versions that you may need to install to continue using the Game.

You acknowledge that we have no obligation to provide any updates or continue to provide or enable any particular features or functionality of the Game.

10. Termination

10.1 Termination by You

You may stop using the Game at any time by uninstalling it from your device.

10.2 Termination by Us

We may suspend or terminate your access to the Game at any time, with or without cause, with or without notice, including if:

• You breach any provision of these Terms
• We are required to do so by law
• We decide to discontinue the Game
• Your account has been inactive for an extended period

10.3 Effect of Termination

Upon termination, your right to use the Game will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Disclaimers and Warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Game will function uninterrupted, error-free, or be completely secure
• The Game will be compatible with all devices or operating systems
• Defects in the Game will be corrected
• The Game or servers are free of viruses or other harmful components
• The results of using the Game will meet your requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JCM STUDIOS, CROSSBLACK STUDIOS, JOÃO DE CARVALHO MILONE, OR OUR AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to, use of, or inability to access or use the Game
• Any conduct or content of any third party on or through the Game
• Any content obtained from the Game
• Unauthorized access, use, or alteration of your data or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless JCM Studios, CrossBlack Studios, João de Carvalho Milone, and our affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Game
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

14. Third-Party Services and Links

The Game may contain links to third-party websites or services, including advertisements. We do not control, endorse, or assume responsibility for any third-party websites, services, or content. Your interactions with third-party services are governed by their respective terms and privacy policies.

We are not liable for any damage or loss caused by your use of or reliance on any third-party content, goods, or services.

15. Age Restrictions

The Game is not intended for children under the age of 13. By using the Game, you represent and warrant that you are at least 13 years old. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that your legal guardian has reviewed and agreed to these Terms.

16. Geographic Restrictions

The Game is available worldwide, but we make no representation that the Game is appropriate or available for use in all locations. If you access the Game from outside your home territory, you are responsible for compliance with all local laws.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Game shall be resolved through good faith negotiations. If the parties cannot resolve the dispute through negotiation, the dispute shall be submitted to the competent courts of São Paulo, Brazil.

18. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms. Material changes will take effect 30 days after they are posted.

Your continued use of the Game after any changes become effective constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Game.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid, enforceable provision that most closely matches the intent of the original provision.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JCM Studios (published by CrossBlack Studios) regarding the Game and supersede all prior or contemporaneous communications and proposals, whether oral or written.
